Terms of Service
Effective Date: January 1, 2026 | Last Updated: September 2026
1. Acceptance of Terms & Service Scope
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Homeowner," or "Customer") and HVAC Repair in Dallas ("Company," "we," "us," or "our"). These Terms govern your access to and use of https://hvacrepairindallas.com, including any content, functionality, diagnostic guides, cost calculators, online estimate request forms, and telephone dispatch coordination services offered on or through our platform.
By accessing this website, submitting an inquiry form, or placing a telephone call to our dispatch lines, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of this website.
2. Business Model & Referral Network Disclosure
Notice Regarding Contractor Independence: HVAC Repair in Dallas operates as a consumer referral and dispatch coordination platform. We connect Dallas-Fort Worth property owners with independent, third-party air conditioning and heating contracting companies.
- Independent Contractors: The service technicians and companies dispatched through our network are independent contractors, not employees, agents, or joint-venturers of HVAC Repair in Dallas.
- Direct Contractual Relationship: When you authorize HVAC diagnostics, repairs, tune-ups, or equipment installations, you enter into a direct contractual relationship with the dispatched independent licensed contractor. All warranties, guarantees, billing transactions, and workmanship representations are made directly between you and that specific servicing entity.
- Licensing Verification: All partner contractors in our referral network are required to maintain active Class A or Class B Air Conditioning and Refrigeration Contractor licenses issued by the Texas Department of Licensing and Regulation (TDLR) and carry a minimum of $2,000,000 in commercial general liability insurance.
3. Upfront Pricing, Estimates & Diagnostic Fees
We are committed to total pricing transparency across the Dallas-Fort Worth HVAC market. All pricing benchmarks, cost ranges, and calculator outputs displayed on this website are illustrative estimates based on regional contractor billing surveys, HomeAdvisor/Angi Dallas market data, and historical invoicing averages.
Diagnostic Service Fee: When a partner technician is dispatched to your property, a standard diagnostic inspection fee applies. This fee covers the technician's travel, physical vehicle dispatch, electrical testing, and diagnostic evaluation. If you approve the needed repair during the same service visit, 100% of your initial diagnostic fee is credited directly toward the repair total. If you decline the recommended repair, you are responsible solely for paying the diagnostic fee.
Written Fixed Quotes: No repair work will commence without your prior written authorization. Dispatched technicians provide an itemized, upfront quote detailing parts and labor before initiating any mechanical or electrical repairs.
4. Workmanship Warranties & Guarantees
All standard component repairs performed by partner technicians carry a minimum 1-year warranty on replacement parts and labor. If a repaired part fails under normal residential operating conditions within 365 days of installation, the servicing contractor will return to inspect and replace the defective component free of charge.
Manufacturer warranties on newly installed air conditioners, heat pumps, and gas furnaces (typically 10 years on compressor and functional parts) are provided directly by equipment manufacturers (Carrier, Trane, Lennox, Rheem, etc.) and are subject to their registration terms and documented annual maintenance requirements.
5. Telephone Consumer Protection Act (TCPA) Consent
By submitting your phone number via our online quote forms, quick problem finder forms, or scheduling requests, you grant express written consent authorizing HVAC Repair in Dallas and partner licensed contractors to contact you by telephone call, live agent, pre-recorded voice message, autodialed call, and text (SMS/MMS) message regarding your service inquiry.
Consent is not a condition of purchasing any product or service. Standard message and data rates may apply. You may revoke communications consent at any time by replying "STOP" to any text message or by notifying the dispatcher verbally during a call.
6. Limitation of Liability
To the maximum extent permitted by applicable Texas law, HVAC Repair in Dallas, its affiliates, officers, directors, and referral coordinators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, property damage, water leaks, electrical damage, or personal injury resulting from services performed by independent third-party contractors.
Each independent contractor maintains independent commercial general liability insurance and workers' compensation coverage to protect homeowners against accidental property damage or mechanical failure.
7. Governing Law & Dispute Resolution in Dallas County
These Terms and any dispute arising from your use of this website or referral coordination shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in Dallas County, Texas.
